In Poland, collecting sheds outside national parks and nature reserves is not banned, but the law limits where and how you may search. In parts of Europe sheds belong to the holder of the hunting right, and taking them is a crime. In the western US, states set seasons and closures. This is the legal picture as of October 2026.
Poland: who owns a shed antler
The Polish Hunting Law says that game animals living in the wild belong to the State Treasury (Art. 2). The act does not mention antlers or sheds, though. A shed antler is no longer part of a living animal. In practice it is treated as an ownerless thing, which becomes the property of whoever finds and takes it (Art. 181 of the Civil Code).
We found no court ruling and no official statement from the ministry or the State Forests that settles this directly. Polish law does not give hunting clubs an exclusive right to sheds, as German or Czech law does. Some clubs still regard sheds in their hunting district as theirs and dislike outside collectors. Talking to the club avoids conflict.
Where it is not allowed in Poland
- National parks and nature reserves. Art. 15(1)(3) of the Nature Conservation Act expressly bans collecting antlers there. This includes marked trails. The exceptions cover things like conservation work and research, not ordinary collectors.
- Wildlife refuges (ostoje), young plantations up to 4 m tall, research plots and river springs in state forests are under a permanent entry ban when marked with a sign (Art. 26 of the Forest Act).
- Forest under a temporary entry ban, for example in high fire risk or during logging. The forest district manager imposes it.
- Military areas and training grounds, such as Świętoszów and Drawsko.
- Private land where the owner does not agree. On farmland, keep off sown crops.
Landscape parks and Natura 2000 sites have no general ban on collecting sheds, but they often contain nature reserves.
Searching within the law in Poland
In forests you may not disturb, chase, catch or kill wild animals, and you may not let dogs run loose (Art. 30(1)(12) and (13) of the Forest Act). The Hunting Law bans disturbing game outside hunts (Art. 9(1)(2)). Driving on forest roads closed by a barrier or a sign is also banned.
A skull with antlers or a dead animal is not a shed. Do not take it. Report the find to the hunting club or the forest district.
Poland: selling
The Hunting Law bans selling dead game animals and their easily recognisable parts, except those obtained legally or acquired in another legal way (Art. 9(1)(4)). A shed collected legally, outside a park or reserve, falls within that exception. So it is worth remembering where and when you found it. Sales are common on Allegro and OLX. We cover tax in how much are shed antlers worth.
European deer, that is red deer, roe deer, common fallow deer and moose, are not covered by CITES. CITES covers only some rare subspecies and species from outside Europe, such as the Kashmir stag. When shipping outside the EU, also check the customs and veterinary rules of the destination country.
Germany and Austria: do not collect
In Germany the right to take shed antlers (Abwurfstangen) belongs exclusively to the person entitled to hunt the ground (§ 1(5) of the Federal Hunting Act, BJagdG). Taking a shed without their written permission can be poaching (Jagdwilderei, § 292 of the Criminal Code). In Austria sheds also belong to the hunting right holder, and taking them is a criminal offence against another's hunting right. That is why our forecast has no spots in these countries.
Czechia, Slovakia, Hungary
In Czechia the hunting right includes appropriating shed antlers (shozy paroží) in the hunting ground (§ 2(h) of Act 449/2001). Do not collect without the hunting ground user's consent. In Slovakia and Hungary the rules are, to our knowledge, similar, but we have not confirmed them in the text of the acts. Ask the hunting ground manager before you go.
Scandinavia, Scotland, Switzerland
The right of public access in Sweden and Norway lets you walk in the forest and pick berries and mushrooms, but it does not mention antlers. Sheds may belong to the landowner or the hunting right holder. In Scotland, access rights under the Scottish Outdoor Access Code do not extend to taking things away for commercial purposes. In Switzerland the cantons set the rules, and wildlife rest zones have seasonal bans. In these countries ask the landowner or the local authority before taking anything.
United States
In US national parks it is illegal to remove parts of wildlife, including antlers (36 CFR 2.1). On other public land, states set the rules:
| State | Main rule |
|---|---|
| Utah | from January 1 to May 31 you must carry a certificate from the free Antler Gathering Ethics Course |
| Wyoming | public land west of the Continental Divide closed until 6:00 a.m. on May 1, for non-residents until 6:00 a.m. on May 8, with a conservation stamp |
| Colorado | public land west of I-25 closed from January 1 to April 30 |
| Montana | Wildlife Management Areas closed from December 2 until noon on May 15 |
| Idaho | non-residents need an Idaho hunting license, and winter ranges may be closed seasonally |
National wildlife refuges, such as the National Elk Refuge in Jackson, have their own bans. Private land requires the owner's permission.
Canada
Removing antlers from Canada's national parks is prohibited. On provincial public land the rules vary. Alberta's hunting guide notes that a shed antler that is legal to sell in Alberta may not be legal to sell to buyers in the US.
What to check before you go
- National park and reserve boundaries on the map.
- Entry bans announced by the forest district or land agency.
- Abroad: who has the right to sheds and whether you need permission, a license or a course.
- Dates of seasonal closures.
